'Open-Carry' a Central Gun Rights Issue Analysis

Repost from My E-mail! Thanks, Barbara

'Open-carry' becoming central gun-rights issue
Visible firearms bring disorderly conduct charges

Richard Moore
Investigative Reporter

News Analysis

For most of this decade, the most contentious gun issue in Wisconsin has been that of concealed carry, or the legal sanction to carry a firearm in public in a hidden manner, either on the body or in close proximity.

But this year that affair may take a backseat to a rapidly intensifying debate about the legality of open carry, or the act of publicly carrying a firearm in plain view.

Ostensibly, Wisconsin is an open-carry state, meaning there is no law against a law-abiding citizen openly carrying a legal firearm. Theoretically, at least, one could strap on a holster and pistol and go buy groceries, or plant trees in one's own yard, whether or not such an action might be wise.

Indeed, Wisconsin remains one of only two states in the nation not to allow some form of concealed carry, and one of the most-repeated arguments used by concealed-carry opponents is that it is not necessary because citizens can openly carry their guns.

Then attorney general Jim Doyle used that precise argument before the state Supreme Court in Wisconsin v Hamdan, in which the state carved out a concealed weapon exemption for small business owners.

As governor, Doyle reportedly reiterated his belief at a Lake Delton press conference, in which The Wisconsin Dells Events quoted him as saying, "If you want to carry a gun in Wisconsin, wear it on your hip."

Then again, maybe not, if the attitudes of other state officials, not to mention more than a few police actions, are any indication.

Doyle's proclamation notwithstanding, others in his administration take a wary view of wearing a gun openly on the hip, and their message is, if you do it, you're inviting trouble.

For example, Wisconsin Department of Natural Resources hunter education administrator Timothy Lawhern wrote last year that openly carrying a gun would likely provoke an unsympathetic and severe response from law enforcement officers.

"Note that the officer on the street doesn't expect to see firearms openly exposed," Lawhern wrote in the April 2008 issue of the Wisconsin Hunter Education newsletter. "In most cases when they do see a firearm, they draw theirs and tell the person 'Let me see your hands! Don't move!' In some cases they yell, 'Put the gun down,' or 'Drop the gun!'"

Him or them?

So whom should the public believe, the governor or his underlings?

Those who are inclined to place faith in the governor's words and legal contentions might want to consider the case of West Allis resident Brad Krause, whose experience last summer while wearing his legal firearm on his own property eerily recalled Lawhern's stern admonition.

According to multiple reports, on Aug 22, 2008, Krause was at home planting trees - with a holstered firearm on his side. That prompted a neighbor to call the police to ask if that was legal.

It wasn't, at least to the West Allis police. The department dispatched two squad cars to his residence and, after approaching him with their weapons drawn, ultimately arrested him for disorderly conduct, says Gene German, a gun-rights advocate who has followed the case closely.

"The police had him standing in handcuffs on his own property for 45 minutes with squad cars parked in front of his residence while they tried to figure out a way to arrest him," says German, who is the state director of the American Association of Certified Firearms Instructors and one of the founders of Wisconsin Patriots, a grassroots organization whose declared mission is to "encourage our fellow citizens to restore, exercise and preserve their individual rights, including the right to be safe."

"They shortly discovered Brad had no criminal record and was lawfully openly carrying on his own property, but instead of releasing him and returning his weapon, they tried to figure out how to arrest him. A call to the supervising lieutenant provided the answer: claim his action of carrying a weapon is disorderly conduct, and haul him down to the station. His firearm was taken away from him without a receipt, and it has not been returned. The police have effectively banned his exercise of his right by disarming him."

German says the case involves a host of important issues.

"We are concerned about Brad being on his own property because the right to bear arms is not nor should it be limited to bearing arms on one's own property," he said. "The issue of his being on his own property should only make the unconstitutional infringement of his right more distasteful to people."

Then, too, there's the overriding question of whether open carry is even legal in the state, which calls second-amendment rights into question, given the illegality of concealed carry.

"The Supreme Court has said if the right to keep and bear arms amendment in the constitution is to mean anything, then there must be some reasonable means to exercise that right, and if the sight of a firearm is all it takes for the police to deny your right - they took his gun - that right is [infringed]," German said.

A disorderly end run

The disorderly conduct charge makes the issue even more complicated. That's because, while open carry is ostensibly legal, police have used disorderly conduct as the principal means by which to forestall the practice, which a September 2000 Legislative Reference Bureau memorandum pointed out for anybody thinking about doing so.

"Wisconsin law does not specifically prohibit the open carrying of loaded or unloaded firearms in public, but a person doing so may risk being arrested, and charged with disorderly conduct, on the grounds that the display threatens the public peace or safety," the brief stated.

That rankles open-carry advocates, many of whom believe that defining the very act of carrying a legal firearm openly as disorderly conduct - without any associated provocation, illegality, or disturbance - creates a new and de facto law against open carry.

"When you're dealing with a protected right, you can't use the same standard that would apply to someone being disorderly in a bar," German told The Lakeland Times last week. "You can't apply the legal standard to disorderly conduct for someone who is just being obnoxious in a bar as being the same standard that we use to measure [whether the state can] use its police powers to deny someone the exercise of a protected right. You have no protected right to be disorderly in a bar, so the standard they can use to stop that behavior is much lower. It doesn't fit [in open-carry cases]. You're talking about stopping a right, not just stopping disorderly conduct."

German said the state Legislature never intended to ban the open carry of firearms, and, in fact, the law against concealed carry was meant to underscore that right.

"The fact is, the concealed weapon [ban], the reason it was enacted was not to ban the carry of guns," he said. "That is the open-carry statute. The legislative intent was to prohibit people from carrying a concealed weapon. The Legislature was really trying to force people to openly carry them."

Still, those arguments have not stopped police agencies around the state from arresting people just as the Legislative Reference Bureau forewarned, or acting as Lawhern predicted they would.

The charge is in fact common enough: in addition to Krause, another man in the Milwaukee area was charged with disorderly conduct last year after he entered a West Milwaukee retail outlet with an openly displayed gun, according to Milwaukee Magazine.

Federal court

However, a Dec. 4, 2008, declaratory judgment in the United States District Court for the Southern District of Georgia could rattle the law enforcement establishment's legal underpinning.

In a case involving Zachary Nelson Mead, the court adopted a settlement in a case similar to Krause's, declaring that seizing a firearm for no reason except that it was openly carried violated the Fourth Amendment's protection again unreasonable search and seizure.

Mead filed a federal civil rights action after a Richmond County sheriff's deputy, Tadum Townsend, stopped him outside a Kroger grocery store as Mead was returning to his car from shopping, according to federal court records. Mead was carrying an exposed handgun in a holster on his belt.

In Georgia, a person must have a firearms' license to carry such a firearm openly, though Mead had a military exemption from the law. Even so, he had the license.

Without his consent, the court stated, the deputy seized the pistol, even though Mead handed the officer both his military identification and the firearms' license.

Though the sheriff's department eventually returned the firearm, Mead sued, contending the deputy had no probable cause to believe Mead had or was about to commit a crime and had no reasonable 'articulable' suspicion that he was committing or about to commit a crime.

As the court noted in summarizing Mead's arguments, federal case law allows officers to conduct investigatory stops without a warrant only if "the officer has a reasonable, articulable suspicion that criminal activity is afoot." To make a showing that he or she in fact had reasonable suspicion, the court continued, "[t]he officer must be able to articulate more than an 'inchoate and unparticularized suspicion or hunch of criminal activity.'"

So, the court wondered - and this is where the Georgia case becomes relevant - does the mere existence of an openly carried firearm represent reasonable articulable suspicion that "criminal activity is afoot"?

Or, to rephrase the question using the Wisconsin context, does the mere existence of an openly carried firearm represent conduct that an officer might reasonably believe is causing or provoking a disturbance by its presence only, or is likely to, to use the statutory definition of disorderly conduct?

"While plenty of case law exists on what conduct justifies a stop under the Fourth Amendment, there is no case law in the Eleventh Circuit on whether the Fourth Amendment is violated when a person is stopped merely for the presence of a pistol in a holster, with no accompanying facts indicating the commission of a crime," the judgment stated.

And, it continued, though the U.S. Supreme Court has concluded that there is no automatic 'firearms exception" to the Fourth Amendment, "[t]he present case presents the situation of whether the officer had authority to make the initial stop. . ."

The court then cited a number of precedents in which the mere presence of a gun did not justify a stop.

For example, the court noted, in United States v. Dudley, the court held that "a radio call alerting police to the presence of two people in a vehicle with firearms did not provide reasonable suspicion of a crime justifying a stop, because possession of firearms is not, generally speaking, a crime."

Then, too, in United States v. Ubiles, the district court observed, the Third Circuit Court of Appeals unanimously held that a tip that a celebrant at a festival was carrying a pistol was not sufficient to justify a stop of the celebrant.

"For all the officers knew, even assuming the reliability of the tip that Ubiles possessed a gun, Ubiles was another celebrant lawfully exercising his right . . . to possess a gun in public," the Ubiles decision stated.

As in both Dudley and Ubiles, the court observed, Mead contended he was stopped merely for possessing a firearm, and, going beyond the facts in those cases, the firearm was seized even after the investigation revealed no crime whatsoever.

"Plaintiff further contends that at the time of the initial stop, Deputy Townsend was not in possession of any facts that would lead him to believe that Plaintiff was committing or about to commit a crime, and Deputy Townsend was not aware of any facts that would tend to indicate that Plaintiff was carrying the firearm or possessing the firearm unlawfully," the court summarized.

Obnoxious but not disorderly

Of course, the sheriff's department had its arguments, too.

According to the deputy, who was on routine patrol in the Kroger parking lot, "he was waved down by a customer who indicated there was an individual in Kroger acting in a bizarre and obnoxious manner and carrying a firearm."

The deputy was also told that another man wearing a sombrero and carrying a guitar accompanied the man with the gun. The deputy further said he received complaints from another shopper and a store employee.

Outside the store, the deputy stated, he approached Mead, and seized his firearm for the deputy's "protection and safety."

"Deputy Townsend believed that he could smell alcohol on Plaintiff and questioned the Plaintiff about whether he had been drinking," the judgment states. "Plaintiff denied that he had been drinking but the officer noted that Plaintiff had purchased alcoholic beverages from the Kroger store. In the abundance of precaution, Deputy Townsend seized the firearm, gave the Plaintiff a property receipt and informed him that he could retrieve the firearm from the Sheriffs Office."

No charges were filed, though - not even disorderly conduct - and the case never proceeded to trial because the sheriff's department dropped its arguments and conceded it had acted inappropriately.

The case achieves some importance because the court granted Mead a declaratory judgment. In such a judgment, a judge delivers a determination of the rights of each litigant. It must be dispositive of a real-life and not hypothetical dispute within the court's jurisdiction, but it is conclusive and legally binding.

"Pursuant to the agreement and the terms of a settlement between the parties, plaintiff's prayers for declaratory judgment are granted, in part, against Townsend and the Court declares that Deputy Townsend by the seizure of Plaintiff's firearm and requiring him to retrieve it at a later date from the Sheriff's Office under the facts and circumstances of this case violated Plaintiff's Fourth Amendment rights of the United States Constitution," the court declared in the Mead judgment.

Similarities

The declaratory judgment, while limited in legal value, does provide a look at the trend in federal legal doctrine, based as it is in part on the court's interpretation of existing case law. Accordingly, it provides some limited instruction not just on the Krause case but on the general legitimacy of using disorderly conduct charges to prosecute the open carry of firearms.

In the Mead case, the court concluded, the officer had no right to seize the firearm because the officer "under the facts and circumstances of the case" had no articulable reason to believe a crime was being committed but was instead acting solely on complaints from other shoppers.

Similarly, in the Krause case, officers acted solely on a phone call from a neighbor who was inquiring about the legality of Krause's firearm.

Then, too, in Mead, police continued to hold the weapon even after the officer ascertained no crime was being committed; in Krause, too, seizure continued after officers determined Krause was committing no crime beyond what they considered to be the illegal presence of the gun.

In some ways, Krause's arguments could be considered more potent than Mead's. For example, unlike Mead, Krause was on his own property and there were no complaints about drinking or obnoxious behavior.

But the most critical issue is more general than Krause - whether the mere presence of the gun constitutes disorderly conduct.

In the eyes of the federal district court in Georgia, the answer was no.

Indeed, applying the conclusions in the Dudley and Ubiles cases, that coloring of the disorderly conduct statute would seem to wander beyond the lines. Specifically, if reporting that people have firearms is not sufficient for the police to stop them because it is not sufficient by itself to establish the likelihood of a crime, then merely having an open firearm is therefore not a crime and, at least in the logic of federal law, could not be considered disorderly conduct.

Nor could the presence of the firearm be sufficient to conclude that it would likely provoke or cause a disturbance..

In fact, German says, in his experience, exactly the opposite is true.

"In the five years, six months and 13 days, give or take a few, that I have been openly carry a gun [in Minnesota], when people see my gun, number one, they don't go running and screaming the other way," he said. "They generally ask me if I am a cop or a bounty hunter - I used to have a pony tail - but the point is that there are all sorts of good guys carrying guns. Nobody has ever come up to me and asked, 'Are you a criminal or a bank robber?' And you know why? Because I'm not acting like one."

First, a local decision

As for Krause, he is not in federal district court, nor even in state court. He is in municipal court, scheduled for another hearing Feb. 17, in a case German says is likely to be appealed

"No matter who wins we certainly believe it will be appealed because we don't believe the city of West Allis is just going to roll over and let people openly carry guns, the way they handled this one, and if Brad loses, we don't want that, either," German said last week.

And while many think the case is headed for the Wisconsin Supreme Court, it could go even further - to federal court.

One way or another, the Krause case has sharpened attention over an issue that has been seething beneath the surface for years. German says that's not because he and others haven't tried to call media attention to it.

"Civil rights are very important - all of them - which is why they are protected from governmental actions just like this," he said. "The media would be all over this story if a voter had been wrongly arrested while waiting in line to vote, or a worshipper had been arrested while attempting to enter their place of worship, or a reporter was arrested while writing an article."

German said the Wisconsin Supreme Court has determined that an otherwise reasonable exercise of police power cannot be invoked in a way that 'destroys,' 'frustrates,' or 'nullifies' the constitutional right to bear arms, yet that is exactly what is being done by law enforcement departments all over Wisconsin.

In the end, he said, the Krause case is about a whole lot more than guns.

"It's about liberty," German said. "The intended purpose is to re-establish freedom and liberty in Wisconsin. It's not about the tool or about the fact that it may involve a firearm. Rights are being unlawfully infringed upon by law enforcement officers and the Supreme Court has agreed that if you're going to eviscerate someone's right, you better have a good reason. Disorderly conduct does not rise to that reason."

That's still to be decided, of course, and it may be a while before citizens know whether the police will be able to continue to arrest people at the mere sight of a gun or demand that they turn it over for no reason, as the DNR suggests, or whether Doyle's words can be taken at face value.

In the meantime, it might not be wise to wear your pistol while planting trees or buying groceries, especially if you are accompanied by a man wearing a sombrero and carrying a guitar - apparently a dead giveaway for disorderly conduct, if ever there was one.

Kraus' case can only go to the US S. Ct. if there is a federal question decided by the Wisconsin S. Ct. that the US S. Ct. decides to review - it is not likely that there will be any such federal question as state law issued predominate in this case.

What gun owners need to do in Wisconsin is get the hell out of criminal court where the government controls the litigation - Section 1983 claims against the government for executing "catch 'n release" campaigns of harassment - Plaintiffs control civil litigation and the government hates it.

Further, open carriers in WI need to get in the press - I know its cold up there, but this hide from the press strategy is like Custer leaving behind his gattling guns at Little Big Horn!
Thats how the folks in PA, VA, GA, and LA have won the battle - guns, lawyers, and press.
Mike: PRECISELY! I found this article because I stopped in at another forum. Besides the coverage of the topic in general, I was (finally, grrrrrrr) so glad to see someone go in print on the record about the Brad Krause case and cite other examples of abuse/ignorance of simple statutes and fold Doyle's role into the whole thing from a correct historical viewpoint. When people hide their heads and close their mouths about this kind of thing - a tactic which those in PA, VA, et al already know doesn't work - the decisions get made by those who DID show up.

When things happen like what has happened (and still is happening) to Mr. Krause, we should be screaming as publicly as possible (in a civil manner of course). It is the only way those morons will understand, to cast their devious personae directly into the limelight. Instead of "The City of Blah has elected to file charges..." it should be made known that "city police acting under improper authority because of poor guidance by the City DA Mr/Mrs Firstname Lastname..."
No, they should be deposed by civil rights lawyers. This requires a civil action by a Plaintiff with good facts and willing to be on TV speaking to the press.
Bingo. It takes a well-lit stage to bring to light that the alleged "remedy" for 941.23 is, in execution, no remedy at all and is, therefore, a right denied. Now, to get someone in a mainstream paper to grab the salient nuggets from Mr. Moore's fine piece...
I disagree. That sacrifice can be done intelligently and our forefathers knew it, which battles to fight, which ones to disengage from. Everyone has to live with their own responsibilities and, for many, to completely take themselves out of the game and deprive their families is not an option when there still appear legal remedies to be pursued.

I don't think you're saying that, under any condition including a brief Terry-stop (and please don't get into debating Terry), you'd go to guns with an officer while he sorted things out. If you did, it would likely happen without reliable witnesses, maybe two people would be found dead. One would be in police uniform, one would not. Who wins the perceptual game then? What would have been accomplished is that now you've reinforced the hand-wringers predictions that officers are even less safe with even supposed law-abiding citizens on the street who are armed. And the internet forums would live on and say things like "I wasn't there, but it sounds like he wasn't doing personal carry or the 2A any good so, well, bye... Too bad for the officer's family."

There are good people all over who possess the resolve to keep working it until governmental systems have broken down and many of them live in WI - otherwise we'd have given up a long time ago and, for example, would've never been one of the first to pass a law after Katrina stating that firearms cannot be confiscated during a disaster even by those operating under an emergency authority.

So... can we get back to the issue of OC, Mr. Krause's resolve, and Mr. Moore's fine article?
Indeed sir, and the victim made the decision that his backyard wasn't going to be his Alamo. I'm just not going to assume because a person doesn't make their last stand then & there, on their own property or not, that they lack resolve. I think pursuing the case through the court system with the financial & societal risk attending, shows quite the opposite.
Removing the Estabrook Park Dam is a terrible idea.
In his letter printed January 1st, Stopping rivers is bad for the environment,Tim
Vargo stated that dams interfere with the natural movement of sediment. I believe
that Mr. Vargo has oversimplified the situation and used generalizations that are not supported by common sense, facts, water testing, or sound environmental ideals for this reach of the Milwaukee River.

Losing the Estabrook Park Dam would cost Milwaukee County exponentially more than repairing it.(tens of millions at least) This is the largest inland lake in Milwaukee County. Why lose this historical and recreational gem? The area has often been hit by floods; why lose this important flood control defense? The methodology and resultant dumping during past dam removals, if scrutinized, would likely violate the Great Lakes Compact law and could imperil Milwaukee County to damage lawsuits from the riparian owners, who have water rights according to the Prior Appropriation Doctrine. The watercourse has been at the same normal water level throughout history, but for the past 72 years the Estabrook dam has provided control to avoid catastrophic flood and infrastructure damage. Let’s not ruin it.
The dam was built by the CCC, WPA and other federal agencies in the late 1930s primarily for flood control and secondarily for recreational use. The project channelized the Milwaukee River in a marshy area on the northern area of Milwaukee County which had previously been plagued by frequent severe flooding. Islands and park areas were built up using the excess soil. More than 6000 linear feet of rock was blasted out to form a retention reservoir and the dam was then installed to raise the river back to its historical natural water level in times of low flood risk. To prevent ice build up
and bridge damage, the water is lowered prior to each winter and raised each spring.
When considering water quality, Mr. Varga might consider the toxins within
the sediment and where they go when they are washed downstream. Mr. Varga referred to wetlands in which fish and plants benefit from the nutrients; he must not realize there are no downstream natural wetlands from this reach of river to Lake Michigan. There is, however, a huge confined disposal facility within the harbor, filled with the toxic sediment that has washed downstream and was dredged from the harbor floor. The Estabrook Impoundment is not natural, but to most closely imitate nature, we shouldn’t take out the dam. Doing so would cause the water upstream to drop 4 feet below the natural level. It would be better to continue to slow the flow, as
the natural wetlands did, to avoid scouring thousands of tons of toxins into Lake Michigan and our drinking water. It is estimated that the sediment load resulting from the
removal of the North Avenue Dam alone dumped more than 300,000 tons of contaminated sediment into the lake. Satellite photos show the 200-mile-long recurring
plumes in

Lake Michigan. In the recent past, at least five other major dams have been removed from the Milwaukee River. The removal of each caused tons of toxins to flow downstream. The Estabrook Park Dam affects hundreds of homes, many of which have been flooded numerous times, and they definitely do not benefit from flooding. In
Our urban area we must intelligently balance human requirements
While encouraging safe, healthy environmental growth.

I
have lived on the river since 1986 and can attest that Mr.
Varga’s
claims of mosquito infestations caused by the dam are not
true; many
suburban areas without streams or ponds have far worse
mosquito
infestations. On the other hand, cryptosporidium and
cladophora
outbreaks have been linked to the nutrients washed into the
lake
accelerated by unnatural scouring of the sediments that
were
unleashed by the numerous dam removals in past years. Fish
habitat
and spawning grounds have been choked beneath the toxic
silt.
Cladophora closed our beaches and Cryptosporidium sickened
403,000
Milwaukeeans, killing some. Don’t be fooled by the
eco-speak.. Look
to the North Avenue Dam; the crumbled bank stabilization
didn’t last
a decade, sections of tattered rubble are leaching poison
downstream.
Graffiti covers the remnants of discarded structures and
noxious
weeds cover the former riverbed. This type of
“environmental
improvement” has no place in in our lake, drinking
water,
backyards, or parks.

Fundraiser for Music Victim Ensues After Fiery Round

Above picture is Deb and Gary at Conway's Smokin Bar and Grill, and unnamed saxophone player- okay he DOES have a name, but I do not know it, but according to him, he had a true love affair with my fav First Lady of Jazz, Ms. Nina Simone....

Greetings!
To update you, we are having a musicians fundraiser benefit for amazing harmonica player, Donald 'Doc' Pfaff, here in Milwaukee, and hope that any organizations and individuals can participate in ways that they are able. I will share the details specifically in an upcoming e-mail, in the next week. Doc is hurt worse than we thought. It is of the opinion that the rotten venue robbers hit him with a bullet from an assault weapon. It is extremely disfortunate that Doc got randomly hurt. He will survive but will not remain the same and will definitely need support, although he suggests that he will not....(he is a very humble person who is very, very wounded, moreso than he wants to admit publicly). In which case, we will set up a fund for him, and then he can redistribute it, at will, elsewhere, if he so desires (German style harmonica education or preservation?) He is a trooper, of the best kind, and plays a rare and complicated style of harmonica's, like few others remaining, in the area, and overall. Please let us know how you will be interested in helping, if you are, or just stay tuned and come to the event. The event/fundraiser will be held at a secure venue, and has donated BOTH stages for performance as well as full production equipment (PA's)...it is in Milwaukee, and is owned by Ian Pesch of The Globe South. He just bought and rebuilt the venue which still goes by it's former name (they have not changed the sign outside yet), and that is Liquor Sweets, on 13th and Montana (near Oklahoma Ave.), in Milwaukee, Wisconsin. Please stay tuned for details, and if you have not heard of this musical tragedy, please read below, for included in this e-mail is what I wrote shortly after the incident. I was rather shaken at the time and wrote it to alert friends and musicians, and not to slight or offend anyone. Oh and by the way, special thanks goes to Musical Legend and Impresario Mark Shurilla, who offered to assist us in throwing this special event, as well as donated his song "Don't Blame the Polka Band' which he wrote in the 80's when Milwaukee's annual 'world reknown' Polkafest was killed and disbanded, when multiple bandits took over and mercilessly robbed event goers, while waiving around their weapons (who remembers this?), and ruined the overall musical movement, held on Milwaukee's Northwest side.As a musician, he/we all feel, that this just is not right, and want to educate the public on safety, and provide ideas and solutions to our community through this experience, as crime goes up and arms flow into the USA. Read the Shepherd Express' view on this problem at hand:http://www.expressmilwaukee.com/article-4966-what-the-gun-industry-and-the-nra-donrst-want-you-to-know.htmlAlso, Thanks go to the NRA- Wisconsin's local chapter is now called We-Force, who may be more 'pure' in intent than this last article suggests, and who will more than likely have an information booth at the event. Music Cares (of the Grammy's), and Finally JAM for SAM (serving ailing musicians) may be present as well, hopefully, with WAMI's (Wisconsin Area Music Industry). Finally, thank you to Ian Pesch of Liquor Sweets, and most importantly to Andy Kochanski of The Concertina Bar, as well as Deb and Gary of Conway's Smokin Bar and Grill for their support, and The Stone in Bayview, and any owner of taverns willing to step up and donate their time and assistance in educating themselves, and their staff, and their venue's musicians, in an attempt to provide an atmosphere sober, cognizant, and safe, for ALL performing artists. Meanwhile, criminals bank on the idea that the rooms are filled with 'waste cases'. To which Andy Kochanski's would supplant, as stated in an article on him and his fine establishment, ....the gunmen were just lucky that they did not get blasted from multiple off duty police and firefighters...., who support public safety and serve vigilant, even though off duty, in many tavern locales throughout our musical town. Now, we would also like to facilitate a tavern crawl to honor those taverns participating in this event. Are there any volunteers to help on this project available? Also, thank you to Don Lorenz of The Milwaukee Harmonica Club, who plan to make a presentation for Doc, as he recoups from his injuries.Thank you for your time.

Please contact me in coordination of all things related!Barbara Meyer-Spidell414.333.3334

written prior:
Kochanski's Concertina Bar, I must note, is a great place, and I and all the musicians should and will still continue to go there to enjoy GREAT live Bluegrass and Polka Performances. It is not in a 'bad' neighborhood. It was just targeted because of the popularity, that night, but the the Bandits learned a lesson the hard way. Kochanski's is always filled with good light hearted musicians, and in no way should suffer as a result from this. Andy Kochanski is a hero, and makes an excellent barkeep and owner. He protected us, his customers and friends, with astounding valor and heroism, and deserves accolades for these heroic efforts, and so does Doc, for his Musician's war wound. I wrote this below right after the altercation and was still probably in shock! I was at Kochanski's Concertina Bar tonight, after our gig at Conway's, when two gunman showed up with Sawed off shot guns and started firing and shot our harmonica player friend Doc (He will survive)...I cannot believe it- unreal...they fired into a group of 4 people standing there in the corner next to the stage (what pr*&%^s! to shoot at a group of humans!) and shot old Doc---one of the finest German style harmonic/harmonica players I know...Praise God that he will survive, and he will, thankfully. One of the gunman was shot in the chest but both got away...what a night beyond- beyond...If I had not recieved a phone call from my 'ex' a minute before, which I did not answer, and went into the Bathroom to check my messages, I would be dead right now, for real. I would have been the only one in the crossfire-- Andy Kochanski, the owner, pulled out his .45 and blasted those guys, but still they got away---but one was hit square in the chest. It was pandemonium. They may have targeted the place because there had been a big Musical Christmas Party there earlier-- it is a popular Musicians hangout because of it's support of Live Entertainment (mostly polka and bluegrass)--No words were exchanged....Andy the owner/barkeep notticed a silhouette of two people walking past the windows in the alleyway ( and thought 'more customers? hmmm'...), so he was looking at the door when they came in- and saw their guns immediately dropped- reached for his, which happened to be right in front of him at an arms length. The gunmen then seeing Kochanski move, started firing at him and the group of people in the corner, and then Andy started blasting away- One gunman reeled back- he had been hit- but spun around and ran out the door....but not before they unloaded the two shots, one hitting the mirror behind the bar, the other, Dear Doc.So there I was in the bathroom, crouching on the floor, dialing 911, thinking 'what the *&^!'. I waited, then I heard all this 'foot shuffling' about- I was thinking to myself the worst- everyone is dead and the gunman are inside still...but to my relief, I then heard a woman say, 'Is that door is locked too?', so I came out and said 'Is anyone hurt?' and they said 'Yes, Doc got shot, clean through.'

...so I went to him and a woman was holding a towel on his wound and he looked okay and said he was going to make it, and we were all freaking out....It went right through his buttox and out the other side, he reached down and put his finger into the hole...dang...and we just waited for what seemed like an eternity for the ambulance and when I asked him if he was in pain, he said 'No, but when it hit me it felt like a sledge hammer'....I said 'Can I take a picture for the band', and he said, 'You better believe it', but the cops showed up and said, 'No way lady', and Andy (the owner) said 'Do it' and the cops said, 'Do and you will be in real trouble', so I only got a few....I could care less about the pictures...I am relieved Doc is okay and I am concerned for society, deeply.... It happened last night- Dec 19th at 1:12 am, I was checking my messages in the bathroom, as I mentioned, so I know exactly, the time...The snow probably took the headlines, as suggested. People are wondering what the motive was: It is of the opinion that their motive WAS robbery but remember- Andy Kochanski (Art Altenburg's Concertina Bar's new owner- 37th and Becher)- he saw their gun first and drew his which made them fire right away at him and the crowd (they shot off 2 and then Andy blasted 5 right back), and when Andy fired back he hit the first guy square (he is a fireman/rescue squad guy and he practices many diciplines- he is a real sinewy and buff, nimble kind of a guy) - He was looking at the door to see who was coming in b/c he saw potential customers pass by the window and was alert to their entry- saw the gun first and drew his---he saved the day, really he did. The gunmen were so covered from head to toe, in black, that you could not tell if they were black, white or hispanic. Andy is fine- he is a hero, in my book, really... I would have been a gonner if I would have been at my seat...I would have taken a bullet, for sure or been grabbed as a hostage, I know this, there is no way that I would have made it- I will never sit in a bar in a vulnreable position like that again, ever.... I asked Doc for the next of kin to contact and he said 'I aint dying'....so that was a relief... He is the old style German harmonica player who has a suitcase filled with those extravagant little button/contraption style harmonicas- a collection worth at least a thousand or more, I am sure, and very state of the Art--no one does what he is doing- he is straight up classic in style, really really really good, and one of a kind.... He will be okay-- but the whole thing was a shocker...

Ontario Border Crossing's Terroristic-Style Attacks Aimed at Women

TRICK OR JAY TREATY? CANADA BORDER ASSAULTS REMIND INDIGENOUS WOMEN OF OLD INDIAN STORY

repost--I am sorry, but I am unaware of the author, but feel this is worthy of posting. Photo taken by yours truly, in, violin playing maverick John Losinecki's garden on Weil St., in Milwaukee.

MNN. Oct. 17, 2008. The hundreds of Mohawk women who have been harassed,
assaulted, threatened, abused, raped, almost killed and “disappeared” at the
Cornwall Ontario border crossing are getting to the point where they must
challenge the Canadian Border Services Agency CBSA goons. This check point has
been illegally put right in the middle of the Mohawk community of Akwesasne
disrupting the normal flow of life, forcing people to submit to questioning and
examinations by officials of a foreign state whose rule we never consented to.

There is no way the CBSA can be confused with honorable defenders of peace
loving people against “terrorism”. Like common criminals the goons have
become terrorists themselves. They behave worse than street gangs. They are
part of a scheme designed to make us defenseless. Their training is created to
take advantage of their primitive instincts and emotions. It’s the “Abu
Graib” syndrome where soldiers tortured, maimed and killed thousands of
innocent Iraqis.

The CBSA goons usually attack the women in packs of 4 to 6 when they catch
these women passing through the border alone, night or day. The goons are well
armed with all the latest so called non lethal weaponry like pepper spray,
batons, handcuffs and other “pain compliance” gewgaws. They now have the
technology to aim and send micro wave pulses to fry us. They also have sound
battering weapons which can destroy internal organs. Other electro magnetic
pulse weaponry can disable electronic equipment and render people
non-functional. They are in the process of forcing everyone to carry biometric
radio frequency ID [RFID].

The goons uniform consists of steel toed shoes, flak jackets with badges that
have numbers instead of names, everything to remove them from personal
responsibility for their brutality. Many look bulked up with steroids and
appear to be under the influence of legal and non-legal drugs. It’s well
known that people under such influence are prone to violent unprovoked behavior.
They act together in an out-of-control frenzy. All levels involved back each
other up, be they border guards, local cops, courts or other crown agencies.
They started out as civil servants and are now “foreign” gangsters who steal
and protect goods stolen from us.

The manufactured 911 event is used as their justification. According to the
December 3, 2001 “Joint Statement on Cooperation” adopted by the Solicitor
General of Canada, Minister of Citizenship and immigration and the Attorney
General of the United States, the main concern is protecting the “flow of
commerce”. They were careful not to mention that what they are protecting are
the resources they are stealing from Indigenous peoples.

The border crossing system is designed to victimize us and eventually eliminate
us, not to protect human rights. There are now over 300 and growing reports of
abuses of our people at Akwesasne. No one is there to defend or protect us.
Because of the climate of fear created by the Canadian government, most of the
complaints have been submitted to the Akwesasne Mohawk Council [who work for the
government] and not to the Canadian government, courts or human rights
commission CHRC. Canadian justice tends to be slow when it isn’t
non-existent. After a two year investigation of one case, the CHRC did confirm
that discrimination took place and an inquiry was warranted. Euro Canadians are
rarely hassled. The average Canadian citizens would probably be shocked to
learn what’s really happening at Akwesasne.

The wise Ms. Red XY, an Indigenous sage of the fourth dimension, has been
watching this. She is urging Mohawk woman to stand up and protect our rights
and that of our children. She is appalled by the behavior these goons are
getting away with. They handcuff the women behind their backs and assault them
in a mob. They subject them to strip searches and get extra jollies by doing
cavity searches.

One elder was almost killed when she was subjected to the well known “stress
position” that is used by the U.S. armed forces in their overseas operations.
She was violently removed from her car, cuffed and put in a cell in the customs
building. While she was suffering a heart attack, she was ordered to bend
forward as one stood in front of her trying to pull her down and another tried
to push her over from behind. This would have caused death, given the heart
attack they had already induced.

Five border guards jumped one woman and tried to rape her in broad day light
while video cameras filmed the whole pileup. The result? She was charged with
assault because she resisted.

One young woman was forced to drive her SUV under an untested VACIS X-ray
machine that was meant for transport and commercial vehicles only. She was
pregnant and lost her baby.

Their favorite trick is to wave the Mohawks through the “Indian lane” and
then accuse them of “running the border”. From then on they give themselves
the right to harass, charge, arrest and assault these women and their family
members for many years.

Women are pulled over for groceries, toys and whatever else the goons feel like
taking. Our cars are searched, torn apart and taken away. When they can’t
find anything, they look for receipts. “Ah, we thought you were up to
something” after finding a receipt for shoes. They are taken into the Customs
building and verbally brow beaten. If the woman reacts defensively, then plan 2
is put into motion. The goons don’t let the woman call anyone to let them
know what’s happening. Some are abused and some have even been
“disappeared”, panicking our families who don’t know what happened to us.

When a women stands up to them, their cop friends follow us on the highway,
stop us and give us tickets. Many put their hands out for money or try to get
us to “help them out with information” on our families and people in
exchange for dropping their threats and charges against us.

Ms. Red XY decided to remind us of an old story about General Clinton when he
was in a battle with the Mohawks. He saw one Mohawk warrior standing on top of
a hill. He sent ten of his soldiers to go up the hill and kill him. A big
fight broke out. Not one returned. His soldiers all died. The lone warrior
stood back on the hill and looked down at the colonial army. General Clinton
then sent 25 of his best up the hill to kill him. Once again, not a one
returned. They too were all killed. Finally, the general send the rest of his
army up the hill to finish off this lone warrior. A huge battle ensued. All
were killed except for one. He limped back bloody and beaten down the hill.
The general asked him, “How could that one warrior stand up to our whole
army?” The soldier answered, “He wasn’t alone. He had a Mohawk woman
behind him”. Is this the new/old reality?

Staff of MNN Mohawk Nation News www.mohawknationnews.com
Katenies20@yahoo.com kahentinetha2@yahoo.com
Composure vs. 'Cougar' an Article on Being a Single Woman

No time to edit today!

The article seemed rather surface-oriented and barbaric. To 'prey' on someone because of the 'looks', seems rather antiquated or even cro-magnum.

I prefer to make them do stunts. More on that later.....in just a moment.

First for example, if I am considering a new mate, when one appears on the scene, these things I note: Is he first marked by interest in me? Are his ears, feet, and words, mouth pointing in my direction? What is he saying? Get real. This should be more than: Are his phermones jarting at me? Imagine: What does he 'look' like to me with my eyes closed?

Then what is his body language telling me at this point? Be scientific. Do not be carnal. Assume that he is 'taken' and wait for all the right signals.

The reasoning is that, all good men have a lady by their side usually, either in the past, currently or eventually, and you must wait for things to unfold. Pouncing is out of the question.

Never hurt a Sister or a Brother. Moving to early could damage the neurosis of those whom we are about to explore. Humans are freaks and fragile. So hang back and watch, women always get hurt first, anyways. Just do a good turn, and think without malice, and be sober.

Then work him like a dog and pony show. Don't give into low scores in any places.

I do not consider his attractiveness yet. That part is too easy. esp. in a world where women are inordinately judged for their physical beauty. The pattern is ugly and must be stopped. Male or female. I have seen earthly beauty cause more pain than pleasure. Is LUST not one of the deadly sins? Stay focussed on the big picture heathens! 'Otherworldly Love' or 'Love that is Out of this World' is the answer. Hope is a plan.

AS I clear my throat, I notice character of dress. I do secretly study his eye movements, and I do listen for slurred speech, and listen for communication skills. Afterall, we are in Tap City. I also assume, that if he is attractworthy, he already has a mate or two that he has to feign off prior to starting any new coup. So I remain in no hurry, and work into the study slowly. Afterall, I have identified my personal reasons for a relationship to myself prior, and it does not have alot to do with facial structure, nor younger age. In fact, if he is visibly younger or older than you, in particularly, do not get into bed with them ever. Moving on....

Then the stunts begin.

Oops, but first: I determine the validity, or set ground rules, of the social or work setting and determine if it is a viable condition for a healthy relationship. If it is a bar, then it has zero chance of survival rate if their is a significant age gap, so that direction should not even be a factor. That stands to reason, I am sure most would agree. If we worked together or met on the job, while one or both people at work, the survival rate is 15-20% at best, all these factor into trust, a major component in playing for keeps.

After that, then I make him do the physical feat of some sort. In Jamaica, I once asked a prospective mate to climb a tree and get the Bread fruit down. I noted how he did it. Does he loft the Bread fruit onto the chicken coop? Or does it crack open on the ground? In West Allis, I asked one man to tear apart and replace my head gasket on my 89 Colony Park. In Milwaukee, I asked one if he could help me clean up my yard. Men are very handy and enjoy showing their strengths. It gives them honor, in most cases. You can get really technical with it, if they have some special literary skills etc. Let them strut their stuff. Let them woo you and amaze you. Be careful because you do not want to have him giving you work related services, that is too much of a crossover. There are a whole new set of discoveries to unearth of you head in that direction. Check to see how he feels about Paul McCartney. That is like giving' the fruits' a metaphorical squeeze. If he has balls, he will say yes. If, No, then run.

Does he smoke? I look at that as well. How does he feel about Legalization? I question him on his woodworking skills, and ask him what type of home loan he has. 30 year fixed? Once I am satisfied, I can allow him to then submit a request for a date, written or phoned, or maybe send some sort of invite via e-mail. How you do that is up to you. Tell him that you'd be interested in discussing some activity or hobby that you have unearthed about him, and suggest that you discuss it further. Flirt naturally if he is single, no one likes a bullshitter, if his singleness is undiscovered, let nothing ride. Walk.

I then adhere to remembering if his answers proved solvency, or at least solicited a small fraction of security reassurement or enhancement? Am I going because I am intrigued or just killing time? I do this to be emotionally honest with myself, and it little matters later if it is 'meant to be'.

It is not until I go on a date with him do I determine if his features are something that I can study in light and angle for the next 50 odd years, but still not before I notice the timbre and pitch of his voice. Does it have a lilt to it? I abhor whiners, and I know this about myself.

After that, I prefer to study peoples reaction to his physical features, take note on his charisma effects on other people and his reaction to them and those reactions. Does he need attention from those around him? Is he crazy?

In this world one just cannot be too careful. Mental stability and clear reasoning is the most important factors, plus a healthy lifestyle, and LOOKS....Angry and Bitter Sounding Cougars, they are definitely NOT a hi-priority, Ms. confusers of age and beauty.

What IS important is their self identity being healthy, and I prefer original, and by that I mean, not contrived or overburdened by society's oft wicked imprint....any negative social imprint should be avoided, if that can happen...I mean you still can fall head first in a vat full of abuse, but strive to handle all essentials in a safe and orderly fashion. Yet, make it look like you are not all about the 'cold and calculative' though. Otherwise we could just call you Hilary or Barbara for that matter. After all things are a go, then cataclysm onward, as nature is calling now....and no time like the present to craft a careful longstanding relationship-non cougaresque and in style.

These were some quick reflections of mine, as the Official, OnE and OnlY 'HOuR LAdY of Alternative Thought' upon reading a 'Cougar Women' article and how I, a 'Women Without Cougar Inclinations' feels it is best to try and practice the Art of Love Finding-Identifying.... and it is written by yours truly: Barbara Ellen Meyer-Spidell or in this case' Hour Lady'---as in "gimme an hour we will work it out." - ...the picture above was taken of me, in tears- broken hearted...so learn from my suffering, please, and listen to what I suggest and allow honor, please, and save yourself the ordeal and stress. There is not room in this world for 'pop cheekiness' with regard to LOVE and The Carnal Fashion Montage Regime. The NewWorldOrder holds Peace Captive alone. Sparing ALL expense at the hands of greedlust. The meek are assuming control here. One should never be predatory, people!...only prepared able and capable of handling a firearm responsibly for self protection!...a whole 'nother subject!

Everyone IS Pro Life Even the Pro Choice by Barbara Meyer-Spidell

This was a Letter to a Friend, and is written by Barbara Meyer-Spidell

Everyone IS Pro Life even the Pro Choice. The difference therein lies in the fact that those who are not 'Pro Preventative Abortion' and turn their backs, assuaging in their own minds that what they are doing what is right, are as good as the murderers themselves. Period. If you are not Pro Preventative Abortion, then you ARE Pro Abortion....because it is one or the other. No one wants abortion. Those who care will try and prevent them.

Personally, I am ProChoice/ProLife...but I support measures that allow birth control access and expansion, even though, I , personally, rarely have used birth control, and hate the effect of it on my own body.

Palin is a liar, she too was discovered to be pregnant prior to being married. I do not fault her for this. I fault her for lying about it and not having the courage and conviction to understand that she did not do anything wrong. Her daughter getting pregnant is a BLESSING. Her early pregnancy itself was a BLESSING. Why lie? That is weak. Certainly not VP material...in my book...it will be a vote for WAR, and DEATH, and STRIFE, if things remain the same.

Palin does not understand the simple principle of catch and release. Had she created a plan to remove the animals and not kill them from a plane, she might've had my vote. I do not know anyone in their right mind who would take an innocent life before reasoning out a way to live harmoniously with the other life form. Murdering the animals is the wrong answer.

I will not vote for her just because she is a woman. That is the least of my criteria. I am pleased that there is a woman up there, do not get me wrong. She is just the wrong woman. She is not a feminist, you realize that don't you? If she becomes VP, she will be raped on the Whitehouse lawn, just as sure as there was a plan to kill the dead woman in the backseat of Sen. Kennedy's car. She is a subterfuge, to fool the women, far removed from the reality of war. God Forbid if you ever had to make a dollar, in order to understand. I hope you understand without having to be placed in other people's shoes. (The humbling we talk about) You earned one dollar- but how does it now feel to earn it, need it, and not get it? As long as you are desensitized by your 'clout', others will go on being dehumanized. I pray you understand the effects of your choices.

I accidently mislead some women when I told them that I though the chances of Roe vs Wade being overturned were slim. I was wrong. I believed what I was being told. The chances are GREAT. The Supreme Court 'Lifers' are aged, and the coup is inevitable. Roe vs. Wade could be overturned, and access to birth control will be reduced because many believe that women should just cross their legs...it is that easy. All it takes it ONE or TWO votes, and then it is allover for your daughters...just as likely as FEMA standing by, as the Militia saves the prisoners but starves the 'looters' in New Orleans- meanwhile babies died on sidewalks with no water and parents begged for the water inside the store they were in front of, as the policia, fresh from Bagdad, relived their Iraq experience on the blacks, yet whites were allowed to break in and get food and water,....and the Governor told the soldiers to stop helping people and start protecting property. 4-5 days without food and water....so many needlessly died. The Daddy's in prison are bought and worked, but if they are not in prison they do not get a job. The border patrol allows aliens to come in and work, while the black males are in prison, so many others have a job in removing the aliens who are being bought and sold and sometimes are not even allowed to hold their own passports, like hostages. The infant mortality rate is rising.

Where ARE YOU? Wake Up!No one EVER thought it would happen....but it did. Wake Up. See. Open your Minds Eye. Understand. For this I pray.

We borrow the world from our children. The land belongs as much to the wolves and bears as to us.

a letter to a friend...by Barbara Meyer-Spidell

Vagina Monlogues Author Speaks Out Against Palin

Eve Ensler on Sarah Palin / Author of Vagina > Monologues

I am having Sarah Palin nightmares. I dreamt last night that she was member of a club where they rode snowmobiles and wore the claws of drowned and starved polar bears around their necks. I have a particular thing for Polar Bears. Maybe it's their snowy whiteness or their bigness or the fact that they live in the arctic or that I have never seen one in person or touched one. Maybe it is the fact that they live so comfortably on ice. Whatever it is, I need the polar bears.

I don't like raging at women. I am a Feminist and have spent my life trying to build community, help empower women and stop violence against them. It is hard to write about Sarah Palin. This is why the Sarah Palin choice was all the more insidious and cynical. The people who made this choice count on the goodness and solidarity of Feminists. But everything Sarah Palin believes in and practices is antithetical to Feminism which for me is part of one story --connected to saving the earth, ending racism, empowering women, giving young girls options, opening our minds, deepening tolerance, and ending violence and war.

I believe that the McCain/Palin ticket is one of the most dangerous choices of my lifetime, and should this country chose those candidates the fallout may be so great, the destruction so vast in so many areas that America may never recover. But what is equally disturbing is the impact that duo would have on the rest of the world. Unfortunately, this is not a joke. In my lifetime I have seen the clownish, the inept, the bizarre be elected to the presidency with regularity.

Sarah Palin does not believe in evolution. I take this as a metaphor. In her world and the world of Fundamentalists nothing changes or gets better or evolves. She does not believe in global warming. The melting of the arctic, the storms that are destroying our cities, the pollution and rise of cancers, are all part of God's plan. She is fighting to take the polar bears off the endangered species list. The earth, in Palin's view, is here to be taken and plundered. The wolves and the bears are here to be shot and plundered. The oil is here to be taken and plundered. Iraq is here to be taken and plundered. As she said herself of the Iraqi war, 'It was a task from God.

Sarah Palin does not believe in abortion. She does not believe women who are raped and incested and ripped open against their will should have a right to determine whether they have their rapist's baby or not.

She obviously does not believe in sex education or birth control. I imagine her daughter was practicing abstinence and we know how many babies that makes. Sarah Palin does not much believe in thinking. From what I gather she has tried to ban books from the library, has a tendency to dispense with people who think independently.

She cannot tolerate an environment of ambiguity and difference. This is a woman who could and might very well be the next president of the United States. She would govern one of the most diverse populations on the earth. Sarah believes in guns. She has her own custom Austrian hunting rifle. She has been known to kill 40 caribou at a clip. She has shot hundreds of wolves from the air. Sarah believes in God. That is of course her right, her private right. But when God and Guns come together in the public sector, when war is declared in God's name, when the rights of women are denied in his name, that is the end of separation of church and state and the undoing of everything America has ever tried to be.

I write to my sisters. I write because I believe we hold this election in our hands. This vote is a vote that will determine the future not just of the U.S., but of the planet. It will determine whether we create policies to save the earth or make it forever uninhabitable for humans. It will determine whether we move towards dialogue and diplomacy in the world or whether we escalate violence through invasion undermining and attack. It will determine whether we go for oil, strip mining, coal burning or invest our money in alternatives that will free us from dependency and destruction. It will determine if money gets spent on education and healthcare or whether we build more and more methods of killing. It will determine whether America is a free open tolerant society or a closed place of fear, fundamentalism and aggression.

If the Polar Bears don't move you to go and do everything in your power to get Obama elected then consider the chant that filled the hall after Palin spoke at the RNC, 'Drill Drill Drill.' I think of teeth when I think of drills. I think of rape. I think of destruction. I think of domination. I think of military exercises that force mindless repetition, emptying the brain of analysis, doubt, ambiguity or dissent. I think of pain. Do we want a future of drilling? More holes in the ozone, in the floor of the sea, more holes in our thinking, in the trust > between nations and peoples, more holes in the fabric of this precious thing we call life?
Super Model Emerges Overseas in WAKE of Dubious Audit by Barbara Meyer-Spidell

Wisconsin 'Super' Model Emerges Overseas in Wake of Dubious Audit

The culture of poverty within the welfare system remains unmitigated and rife with canard. Temporary Assistance to Needy Families (TANF), the ‘Super’model for welfare reform, originating in Wisconsin and replacing AFDC in 1996, fails, yet is launched in Israel, Europe and Australia as a solution to a worsening problem. The Department of Workforce Development and Department of Health and Human Services, in final analysis, determine that 'self sufficiency' for working poor with dependent children is 'mythical', and that state Legislative Audit Bureau (LAB) significantly skewered facts though purportedly nonpartisan.

Human rights organization, Welfare Warriors, protest devastation being caused by ‘welfare reform’ today in the U.S. and beyond. In the wake of discovering a $1.9 billion discrepancy after pouring over Federal and State TANF breakdowns published by LAB, it was conclusive that the LAB report had misconstrued facts through omission of bulk W2 expenditures revealing:

*In Wisconsin TANF family incomes fell 25-50% below poverty levels.

*W2 agencies took $30 million in sanctions from families already below poverty level reducing fixed grant lows averaging $7800 down to $6561.

* Of ‘graduates’ less than 20% were 'self sustaining'. Meanwhile privatized W2 agencies received $149.9 Million in profits.

Maximus, a private W2 administrator in Wisconsin, found guilty of bilking the plan a half million dollars helped bring 'The Wisconsin Plan' overseas. Pat Gowen, spearheading the Welfare Warriors resonates that $1.9 billion out of $3.3 missing in allocations is dubious but may have been the motivating factor in fostering global growth, and then describes the mythical aspect of 'healthy welfare reform' in Israel and the U.S.

She relates that 81% who fall below the poverty line work while their children remain home. Similar to the U.S., parents are forced to work for supplements and not wages, 30 hours weekly. Laborer's Voice, a watchdog organization, spoke out against the policy enforced by the ‘Wisconsin Center’ located in Nazareth. Since beginning in August 2005, 940 families have been terminated because childcare is not part of the program, the situation is becoming catastrophic.

Since it’s recent inflection, Israel mourns a Wisconsin Center Father, who while working off his debt, collapsed and died when his request to return home because of personal illness was refused. This type of mortality has become prevalent. In Milwaukee, during Goodwill Industries 2001 tenure and mid $87 million dollar contract, a child dies while Mother is forced to work. Though son has Cerebral Palsy, no adult summer care is allowed. The same year Goodwill yielded $36million in profits from the plan, and recruits for the company traveled, hosted parties, and without prosecution were found guilty of stealing a half million dollars.

Gowen speculates greed and corruption as the reason why a nonpartisan audit would cover-up truths and reminds us, ‘ Poor Mothers are unpopular among legislatures, and some fear the rocking of the boat would kill the monies allocated for future programs so they stay silent.".

W2 costs more than former AFDC , is laced with ‘erroneous’ pay-outs, but it remains the children who suffer. Other nations guarantee assistance for children to age18, whereas in the U.S. there is no guarantee beyond age12. Most disturbingly, the infant mortality rate, since TANF began, has escalated 37% in Milwaukee County, and this, in our culture of poverty, must be expunged.

'Super' Model Falls by Barbara Meyer-Spidell

'Super' Model Falls

by Barbara Meyer-Spidell

The Wisconsin Legislative Audit Bureau shows that Wisconsin Works or W2 cost more than former AFDC and is laced with ‘erroneous’ pay-outs. Self sufficiency for working poor with dependent children is ‘ mythical’ as Temporary Assistance to Needy Families or TANF , the‘super’model for welfare reform originating in Wisconsin and replacing AFDC in 1996, fails as the nation watches.

Welfare Warriors actively protest the devastation being caused by "welfare reform’ and discovered the $1.9 billion discrepancy after pouring over a Federal and State TANF breakdown from state auditors and reviewing figures from the Wisconsin Department of Workforce Development Quarterly Reports sent to the federal Department of Health and Human Services.

By omitting the bulk of W2 expenditures, the conclusions of the Legislative Audit Bureau report were badly skewed and the fact remain as followed:

*TANF families fall $8,300-11,500 (25-50%) below poverty as per audit by nonpartisan WLAB.

*Dollars spent on W2, fail to include $1.9 billion out of a total $3.3 billion federal and state TANF spending showing W2 agencies took $30 million in sanctions from families already below poverty level by reducing fixed grant lows averaging $7800 to $6561 to balance.

*Moms who ‘Graduated’ earn below poverty wages and only 19% are self sustaining meanwhile Privatized W2 agencies being compensated for this failing receive $149.9 Million in profits.

Only 19% of those families escaped poverty. (Four years after leaving W2 the average income was still only $11,500 for a family of 3.)

W2 is funded primarily by the federal Temporary Assistance for Needy Families (TANF) program. Yet the 272-page audit, which includes charts detailing dollar amounts and percents spent on W2, fails to include $1.9 billion out of a total $3.3 billion federal and state TANF expenditures. The nonpartisan audit also fails to mention this absent $1.9 billion in its Highlights and in the cover letter to the Joint Legislative Audit Committee who requested the audit. Auditors repeatedly concluded that W2 expenditures totaled $1.5 billion from 1997 to 2004.

Welfare Warriors discovered the $1.9 billion discrepancy after requesting a federal and state TANF breakdown from state auditors.

In dollar amounts W2 cost taxpayers $3.3 billion: $1.95 billion federal TANF funds and $1.35 billion state dollars. The state provides 41% of all W2 expenditures and the federal government contributes 59%. Welfare Warriors received these figures from the Wisconsin Department of Workforce Development Quarterly Reports to the federal DHHS.

By omitting the bulk of W2 expenditures, the conclusions of the Legislative Audit Bureau report are badly skewed. For instance, the report states that cash benefits for participants were 38.7% of the total W2 costs. The correct figure should be 13% of the total. "Services to participants" (mandatory work activities, eligibility determination, education, skills and transportation) totaled $591 million. This was 18% of total expenditures NOT 51.4% as reported in the audit. (Table 4, page 18)

With $1.9 billion W2 expenditures overlooked, it is impossible to determine the cost of administration (which is scandalously high).

When the mysteriously missing $1.9 billion is included, the program failures are more pronounced. Using the $3.3 billion figure, the state spent an average of $35,467 per family each year. Yet only 19% of those families escaped poverty. (Four years after leaving W2 the average income was still only $11,500 for a family of 3.) W2 families received a total of $430 million in cash benefits. But W2 agencies received $150 million in profits ($77.9 in unrestricted profits and $71.9 in Community Reinvestment Profits.)

Then in 2003-4, Harvard Medical School took part in a study published by International Journal of Health Services. They found that health care bureaucracy in alone 2003 year cost the United States $399.4 billion. The study estimated that national health insurance (NHI) could save at least $286 billion annually on paperwork,. That is ENOUGH to cover all of the uninsured and to provide full prescription drug coverage for everyone in the United States. The study was the most comprehensive analysis to that date of health administration spending data. The potential administrative savings of $286 billion annually under national health insurance could allow substantial improvements in coverage and quality of care for U.S. consumers who do not already have insurance.

• 81% Of Moms "Graduating" From W2 Earn Well Below-Poverty Wages

• 42% of Employment Secured by Moms under W2 are Temporary Jobs (meaning NO unemployment compensation)

• W2 Agencies Took $30 Million in SANCTIONS from Families with Nothing

• Wisconsin Spent $3.3 Billion from 1997-2004 For Only 13,300 Families Per Year

• Privatized W2 Agencies Received $149.9 Million in PROFITS

An audit of Wisconsin’s $3.3 billion welfare experiment, W2, found that 81% of families formerly on W2 are still struggling to survive. Their earnings are 25%-50% below poverty. ($8,300-$11,500). The audit was conducted by the nonpartisan Wisconsin Legislative Audit Bureau (LAB). It reports that 90% of W2 graduates work in the low-wage service industry: 41.9% in Temp jobs, 19% in Home Health Care and Nursing Homes; 18% in retail services; 11% in food service. (Audit is at www.legis.state.wi.us/lab)

Only 19% of moms who found jobs while on W2 are able to support their families on their income alone. Yet W2’s mandate is to help family heads reach "self-sufficiency." 53% of participants in 2004 were former clients who returned after loss of jobs. Only 43% of applicants were screened for barriers to employment despite state law requiring this.

An average of 13,300 families were "served" each year from 1997 to 2004 to the tune of $3.3 billion dollars. But only 9,362 families received any cash benefits. Each family received an average of $6,561 a year. This was lower than the $7800 fixed grant level because W2 families lost $30 million as a result of sanctions. (W2 agencies sanctioned 20% of their cases by 30% of their grants.)

W2 agencies imposed $30.2 million in sanctions against families with nothing. Women of color were sanctioned at a higher rate than white women.

The audit claimed that W2 agencies "erroneously" paid $1.3 million to 2,500 parents of newborn infants after 90 days ($520 per family). Auditors refer to this as "excess payments." However, families are eligible to receive W2 payments after their infant is 90 days old. The W2 agency is required to assign 30 hours of work activities to the mother when the baby is 3 months. Agency failure to assign work is NOT an excess payment. It is an agency error (perhaps based on simple human compassion.)

In doing research for this article about the reformation of welfare in Wisconsin I was delighted to come across a website for Working Mothers who desist current government standards for the working poor, and who more than point their finger at the overall demoralization of working standards for those struggling to feed and house the poor within their own families; their young children were most struggling. It is the unity of women’s voices who actively protest the devastation being caused by ‘welfare reform’. Their website is http"//www. welfarewarriors.org .

Many suggest that the public actively protest the devastation being caused by "welfare reform."

One woman reading an interview with Senator John Edwards describes this prevalent attitude, as she writes: I was going along, pretty much nodding my head as Edwards talked about how poverty in the South is such an ongoing problem and the toll it takes on people, until I got to this throw-away line:

It's time to finish the job of welfare reform by giving low-income men the opportunity to work and challenging them to take responsibility for doing so. Welfare reform asked young mothers to join the workforce and gave them help to get there. Millions of poor women benefit, but poor men lost ground during the best economy we've ever had. In America today, there are communities where half the young men are out of work.

One cannot help wonder this: Why had they not forced the males or family partners who were most prone to stay at home and one parental care giver, that again was most prone to stay at home, education and study programs, and send what will be the typically male population, as studies suggest, to work and pay for the cost of her schooling and that of support of financial nature to feed and house their own children, and stop perpetuating a negative role model of being inferior and compliment the workforce, straitaway. Then put the onus on training, as already incentivized. Give them a way onto a level playing ground and end their ideas from their Mothers that it is okay for them not to work, that they never leave the nest nor do. Or can they support and nuture their young b/c of their undeveloped skills for the workforce? Demand all male role models, and males with or without children, serve in the positive of their country, and family.

When politicians start looking at social reform as human being and not a way to distort facts and hide dollars. It is the poor who is financing this war.

My Life as a Canvasser for Planned Parenthood

It's been swell. Lots of excercise, plenty of water, and hopefully, if I am lucky, a night without a madperson screaming at me.

What don't people 'get'?

Planned Parenthood is almost singlehandedly eliminating or reducing abortions in disproprtional amounts, compared to any singular 'right to lifer'.

Everyone is PRO LIFE and ANTI ABORTION, including Planned Parenthood! All are, except the Jihad and the KKK, perhaps, basically. Is anyone, besides Planned Parenthood, administering a responsible cup of 'propreventative abortion'?

Most people shut their windows and doors and turn their back on societie's most fundamental need, and instead of stopping or preventing the NEED for abortion, they scream at those trying to protect women's lives until we as women are able to pull our collective mind together on the subject.

It is rather embarrassing. Tonight was particularly embarassing...for me as a women, to witness such profanely useless idolatry among women. Many champion their large hostels in the name of the almighty something or other while others suffer and rot.

Get off your FAT Wisconsin asses and GIVE, why don't you? An ear? An understanding? A listen?

If you are not part of the solution, you are part of the problem. Get with it.

Now, in Bushland, they want to put an end to The Hypocratic Oath...and put 'morals' first. It is a lie; it is a subterfuge. By eliminating a doctors responsivness to adressing a medical NEED, is the elimination of the due diligence or responsible oath taken by a doctor. They should not be called 'Doctor' then-they should be called anything but, and should have a specific conotation, to alert the prospective patient.

No one is suggesting that an ankle surgeon should prescribe birth control, but Aurora or Walgreens should definitely screen or reduce the pragmatic hours in which prescriptions should be filled or written, if that Doctor or Pharmacist does not prescribe to the chosen drop off, filling or request.

What is this world coming to? When will we all be on the same page and agree? Certainly there has never been more polarization in our National History in hundreds of years....on so many subjects...in such a position of weakness as we find ourselves. Many would agree, those in some burbs haven't a clue, like I saw tonight in West Bend. Even yesterday, in Whitefish Bay, there were a collective of individuals who really 'grocked' it, and said to me, 'Hey, we are NOT being touched by what we see in the news, and we can tell by what we are paying for gas, and that is as close as it has come, but we understand. Bush OUT, new blood IN.'

Women need to VOTE on issues important to their rights and the rights of their children.

In the name of the suffragettes, and that Jewish woman, who bore the name of the birthplace of their religious zeal, they so labor over in the face of the 'lowly' canvasser, who, in their eyes, are the root of the problem, they are so unwilling to look at objectively.

The infant mortality rate has risen significantly, in Milwaukee Co. since Bush has taken his place within the administration, according to The Welfare Warriors. When AFDC was replaced by TANF, the children and women have suffered most.

Those lost in their snug smugness, whom I have seen while canvassing, better REALIZE what is unfolding before them, or lest they be the Frog in the frying pan unable to move THEIR feet!

opinions by Barbara Meyer-Spidell

A Eulogy for a SUPER Comet: DJ Rock Dee a Fine Entertainer

The time has come for Milwaukeeans to say good bye to cherished entertainer and DJ, who with flickers of emotion and an empassioned style, bore his own well wishings with such lavishings of caredom on radio regularly, that with a gaping hole, not with just any person's shoes could he be replaced. He was extraordinary.

DJ Rock Dee leaves behind a beautiful wife, and six blessed children, as well a beautiful life with all the trimmings one could never measure.

His sincerity and purity, his clean style, positive attitude and smile bore the markings of a strategic career phenom, focussed family man, and a friend to many.

His illustrious career allowed him to open for Erikya Bahdu, manage a stage at Summerfest, and become a radio personality on prolific 88.9 Radio Milwaukee. He was the poster child for DJ coolness and will be missed by colleagues in the Music Industry.

Often he told Milwaukee listeners to Call Their Mothers, or to Get on the Phone and Call their Grandmothers. He would say 'DJ Rock Dee says you oughta call your Dad, and tell him hello, for me'...and always to remember to 'keep it real'.
WJTI Broadcasts LIVE from Immigrant March

In keeping with WJTI 1460 AM’s commitment to the community we will be carrying the entire “First 100 Days” rally from Veterans Park on May 1st, 2008 live. Milwaukee ’s original Spanish Language station and the only one to offer local programming will be the official radio station to help bring this rally to as many people as possible. Owner John Torres says, “This is just another way we can give back to the community by providing this service to those that can not attend.”

There is an opportunity to make a difference in the community as well by sponsoring the live broadcast of the “First 100 Days” rally. One of only Four sponsors and will receive a minimum of 50 promotional announcements telling listeners that WJTI 1460 will be broadcasting this event live for all of the people that can not make it to the rally so that they can still be a part of this important event. Along with the 50 promotional announcements you can also receive 10 billboard announcements promoting you as a sponsor along with 4 :60 commercials throughout the event.Last year, over 80,000 people marched in Milwaukee for immigrant rights. Not only was it the largest march in state history, Milwaukee was the only major city to see an increase in attendance. WJTI expects that our number of listeners will also increase during this event. Utilize the power of radio to reach this ever growing and increasingly important demographic.

Marchers Gather at 11:00 am, and the Broadcast Begins at Noon. The Route starts at 5th and Washington and ends at Veterans Park. The point of the March is to allow Milwaukeeans to understand what a day in the life of a Milwaukee Employer/Employee is like without Hispanics, in anticipation of them feeling a loss.

SWEET POISON or BAD COKE? YOU DECIDE.

You decide. Read On.One woman writes: In October of 2001, my sister started getting very sick. She had stomach spasms and she was having a hard time getting around. Walking was a major chore. It took everything she had just to get out of bed; she was in so much pain.
Her Timeline: By March 2002, she had undergone several tissue and muscle biopsies and was on 24 various prescription medications. The doctors could not determine what was wrong with her. She was in so much pain, and so sick.she just knew she was dying. She put her house, bank accounts, life-insurance, etc., in her oldest daughter's name, and made sure that her younger children were to be taken care of. She also wanted her last hooray, so she planned a trip to Florida (basically in a wheelchair) for March 22nd. On March 19th I called her to ask how her most recent tests went, and she said they didn't find anything on the test, but they believe she had MS.

Recalling: I recalled an article a friend of mine e-mailed to me and I asked my sister if she drank diet soda? She told me that she did. As a matter of fact, she was getting ready to crack one open that moment.
I told her not to open it, and to stop drinking the diet soda!
I e-mailed her the article my friend, a lawyer, had sent.
Results: My sister called me within 32 hours after our phone conversation and told me she had stopped drinking the diet soda AND she could walk! The muscle spasms went away. She said she didn't feel 100% but she sure felt a lot better. She told me she was going to her doctor with this article and would call me when she got home.
Well, she called me, and said her doctor was amazed! He is going to call all of his MS patients to find out if they consumed artificial sweeteners of any kind. In a nutshell, she was being poisoned by the Aspartame in the diet soda, and literally dying a slow and miserable death. When she got to Florida March 22, all she had to take was one pill, and that was a pill for the Aspartame poisoning! She is well on her way to a complete recovery. And she is walking! No wheelchair! This article saved her life. If it says 'SUGAR FREE' on the label; DO NOT EVEN THINK ABOUT IT! I have spent several days lecturing at the WORLD ENVIRONMENTAL CONFERENCE on 'ASPARTAME,' marketed as 'NutraSweet,' 'Equal,' and 'Spoonful.' In the keynote address by the EPA, it was announced that in the United States in 2001 there is an epidemic of multiple sclerosis and systemic lupus. It was difficult to determine exactly what toxin was causing this to be rampant. I stood up and said that I was there to lecture on exactly that subject.
I'll explain why Aspartame is so dangerous: When the temperature of this sweetener exceeds 86 degrees F, the wood alcohol in ASPARTAME converts to formaldehyde and then to formic acid, which in turn causes metabolic acidosis. Formic acid is the poison found in the sting of fire ants. The methanol toxicity mimics, among other conditions, multiple sclerosis and systemic lupus. Many people were being diagnosed in error. Although multiple sclerosis is not a death sentence, Methanol toxicity is!
Systemic lupus has become almost as rampant as multiple sclerosis, especially with Diet Coke and Diet Pepsi drinkers. The victim usually does not know that the Aspartame is the culprit. He or she continues its use; irritating the lupus to such a degree that it may become a life-threatening condition. We have seen patients with systemic lupus become asymptotic, once taken off diet sodas. In cases of those diagnosed with Multiple Sclerosis, most of the symptoms disappear. We've seen many cases where vision loss returned and hearing loss improved markedly.
This also applies to cases of tinnitus and fibromyalgia.
During a lecture, I said, 'If you are using ASPARTAME (NutraSweet, Equal, Spoonful, etc) and you suffer from fibromyalgia symptoms, spasms, shooting, pains, numbness in your legs, cramps, vertigo, dizziness, headaches, tinnitus, joint pain, unexplainable depression, anxiety attacks, slurred speech, blurred vision, or memory loss you probably have ASPARTAME poisoning!' People were jumping up during the lecture saying, 'I have some of these symptoms. Is it reversible?'Yes! Yes! Yes!
STOP drinking diet sodas and be alert for Aspartame on food labels! Many products are fortified with it! This is a serious problem. Dr. Espart (one of my speakers) remarked that so many people seem to be symptomatic for MS and during his recent visit to a hospice, a nurse stated that six of her friends, who were heavy Diet Coke addicts, had all been diagnosed with MS. This is beyond coincidence!
Diet soda is NOT a diet product! It is a chemically altered, multiple SODIUM (salt) and ASPARTAME containing product that actually makes you crave carbohydrates. It is far more likely to make you GAIN weight!
These products also contain formaldehyde, which stores in the fat cells, particularly in the hips and thighs. Formaldehyde is an absolute toxin and is used primarily to preserve 'tissue specimens.' Many products we use every day contain this chemical but we SHOULD NOT store it IN our body!
Dr. H. J. Roberts stated in his lectures that once free of the 'diet products' and with no significant increase in exercise; his patients lost an average of 19 pounds over a trial period.
Aspartame is especially dangerous for diabetics.
We found that some physicians, who believed that they had a patient with retinopathy, in fact, had symptoms caused by Aspartame.
The Aspartame drives the blood sugar out of control Thus diabetics may suffer acute memory loss due to the fact that aspartic acid and phenylalanine are NEUROTOXIC when taken without he other amino acids necessary for a good balance. Treating diabetes is all about BALANCE. Especially with diabetics, the Aspartame passes the blood/brain barrier and it then deteriorates the neurons of the brain; causing various levels of brain damage, seizures, depression, manic depression, panic attacks, uncontrollable anger and rage.
Consumption of Aspartame causes these same symptoms in non-diabetics as well. Documentation and observation also reveal that thousands of children diagnosed with ADD and ADHD have had complete turnarounds in their behavior when these chemicals have been removed from their diet. So called 'behavior modification prescription drugs' (Ritalin and others) are no longer needed. Truth be told, they were never NEEDED in the first place! Most of these children were being 'poisoned' on a daily basis with the very foods that were 'better for them than sugar.'
It is also suspected that the Aspartame in thousands of pallets of diet Coke and diet Pepsi consumed by men and women fighting in the Gulf War, may be partially to blame for the well-known Gulf War Syndrome.
Dr. Roberts warns that it can cause birth defects, i.e. mental retardation, if taken at the time of conception and during early pregnancy.
Children are especially at risk for neurological disorders and should NEVER be given artificial sweeteners. There are many different case histories to relate of children suffering grand mal seizures and other neurological disturbances talking about a plague of neurological diseases directly caused by the use of this deadly poison.'
Herein lies the problem: There were Congressional Hearings when Aspartame was included 100 different products and strong objection was made concerning its use. Since this initial hearing, there have been two subsequent hearings, and still nothing has been done. The drug and chemical lobbies have very deep pockets.
Sadly, MONSANTO'S patent on Aspartame has EXPIRED!
There are now over 5,000 products on the market that contain this deadly chemical and there will be thousands more introduced. Everybody wants a 'piece of the Aspartame pie.' I assure you that MONSANTO, the creator of Aspartame, knows how deadly it is.
And isn't it ironic that MONSANTO funds, among others, the American Diabetes Association, The American Dietetic Association and the Conference of the American College of Physicians? This has been recently exposed in the New York Times.
These organizations cannot criticize any additives or convey their link to MONSANTO because they take money from the food industry and are required to endorse their products.Senator Howard Metzenbaum wrote and presented a bill that would require label warnings on products containing Aspartame, especially regarding pregnant women, children and infants. The bill would also institute independent studies on the known dangers and the problems existing in the general population regarding seizures, changes in brain chemistry, neurological changes and behavioral symptoms.
The bill was killed.
It is known that the powerful drug and chemical lobbies are responsible for this, letting loose the hounds of disease and death on an unsuspecting and uninformed public. Well, you're Informed now! YOU HAVE A RIGHT TO KNOW!
Please print this out and/or e-mail to your family and friends.
They have a right to know too! I Post this BLOG, because it is of my non-professional medical opinion that we are being systematically poisoned in the name of the almighty dollar. Please let me know when you read this BLOG if you know of anyone who can benefit from this information contained in this BLOG. We need to help one another. Please pass this along.Thank you...Sincerely, Barbara Meyer-Spidell

Ornette Coleman Father of Free Jazz

Grammy Lifetime Achievement Award winner, Ornette Coleman, who also won a Pulitzer Award for Music was featured at the 2007 Bonnaroo Music Festival in Tennessee.

I was there. The day was sizzling, and hundreds dozed on the grasses, beneath the few shade trees. The water supply was limited, and the once bouyant 500 acres, on which the mammoth music fest is held one weekend a year, was now coarse, dry, and getting dustier in the blindstinging heat by the moment.

I and my friend creeped out of the music tent we normally would have sauntered out of in cooler conditions, and plopped on the hard dirt field that had foot long golden grasses already trampled down offering little comfort. We would have panted in that foray, were we able to part our cracked lips.

I searched for dollars, hoping that my friend would buy me some water. I went to the event broke, hoping to reap anything that I could from the rich sounding environment that was afforded by my $1000 dollar VIP camping ticket.

Blaaaiiir Bleep frazoodle doo dee blab blab blee....forget the heat. Let's get back in the tent. Ornette Coleman wails and doowolly wep wap wow affronted our love, confronted our fears, and spanked our ears. We loved it. With full throttle he stuck his stick of dynamite down our ear shafts into our guts. Inward we went....frashizzle doo whomp actzoobop, and made our way back to the front.

If anyone heard about that show, you would know that he then tipped right over. The Father of Free Jazz yawned, and sat on his stool, head bowed he yawned again, rather largely, and then he tipped right over to the ground. He slumped face first, and as he was dropping towards the stage, music lovers jumped up, stage hands lunged forward and somehow he was caught. Out Cold.

By his underarms he was parlayed, and eventually down on the stage, was he. The band had begun to hesitate and then stopped. The Bassman stood holding his Bass. I wondered when he would put it down, or if it was 'his' tech that was assisting Ornette.

The Audience yelled out 'Get him some water.', 'Take off his Jacket, he has too much polyester on for this Heat!', and 'Someone get an Ambulance!'. Camera's flashed. We looked among each other for answers. I left the tent. It was smoldering, and I would be next to collapse, surely if I did not heed my instincts.

Down to the grass I conceded again, and preceeded to call my parents to tell them news of this day. As lovers of jazz, I thought that they should know. Ornette recovered from his heat shock later in the day.

His web page recites:

Fifty years after he astonished the musical world with his initial recorded forays into free jazz, Ornette Coleman remains astounding. Sound Grammar introduces his so-called two-bass band, a quartet featuring son Denardo on percussion and Tony Falanga and Greg Cohen on acoustic bass. The unusual combination works spectacularly well, as displayed on this fervent live album. Now in his 70s, Coleman has lost little in terms of instrumental prowess on his customary alto saxophone (his occasional trumpet and violin remain as attractively flinty as ever); his utterly distinctive writing still stands heads above both his peers and even the most inventive of jazz's younger generations

White Hot Tizzies CD Hits The Mark - plus reviews!-

Where you can buy the cd!
Category: Music

The new CD is called "Stash" and it is available for sale through CDBaby.com here.

This is the official release and not the CDR version. It's been remastered and includes a bonus track from my previous CD single, "Torch Song" (also available here). Our friends at Easter Records are helping with the release.

Early reviews:

The Onion --Rob McCuen has been active in the Milwaukee punk scene since its inception, drumming for Plasticland and Liquid Pink as well as singing (both in front of and behind the kit) for his own combos. In spite of his extensive discography, McCuen's new e.p. "Stash" - recorded with his current band, The White-Hot Tizzies - may be the best thing he's ever done. Featuring local rocker Beezer Hill (Nerve Twins, Gladrags) and ex-Shivvers pop-mistress Jill Kossoris, songs like "Are You a Man or a Mouse?" and "I'm Lower Than I've Ever Been" showcase McCuen's sardonic wit and spot-on pop sensibilities.

The Shepherd Express, Milwaukee --White Hot Tizzies Stash (Easter) While White Hot Tizzies is the latest band fronted by Milwaukee drummer Rob McCuen, the songs and collaborators found on the six-song EP Stash have roots going back to such previous groups as the Ruins and Love Bully. If his revolving door lineups raised eyebrows, McCuen's choice in musicians is bona fide. It would seem the parameters on this disc are aiming between Nuggets-era garage hits and the grandeur of Phil Spector's Wall of Sound. "Life Imitates Art," co-written with bassist Steve Shrank, builds from a pop hook. "Are You a Man or a Mouse," co-written with bassist Ron Turner shoots for the full-on treatment, adding Jill Kossoris' vocals and keyboards to the mix. —Blaine Schultz

The Milwaukee Journal Sentinel -- The two of them make up in energy and experience what they lack in numbers, cranking out pop-rock that underlines the rock and power-pop that accentuates the power. - Jon Gilbertson

Should You Upgrade Girlfriend 7.0 to Wife 1.0?

Here’s a funny joke. I apologize for sending it out people to my blog, but this was was the only place I could think of putting it. Enjoy
Dear Tech Support:

Last year I upgraded from Girlfriend 7.0 to Wife 1.0. I soon noticed that the new program began unexpected child processing that took up a lot of space and valuable resources.

In addition, Wife 1.0 installed itself into all other programs and now monitors all other system activity. Applications such as Poker Night 10.3 , Football 5.0 , Hunting and Fishing 7.5 , and Racing 3.6.

I can’t seem to keep Wife 1.0 in the background while attempting to run my favorite applications. I’m thinking about going back to Girlfriend 7.0 , but the uninstall doesn’t work on Wife 1.0 . Please help!

Thanks,
Troubled User…..

___________________ __________________
REPLY:
Dear Troubled User:

This is a very common problem that men complain about.

Many people upgrade from Girlfriend 7.0 to Wife 1.0, thinking that it is just a Utilities and Entertainment program. Wife 1.0 is an OPERATING SYSTEM and is designed by its Creator to run EVERYTHING !!! It is also impossible to delete Wife 1.0 and to return to Girlfrie nd 7.0 . It is impossible to uninstall, or purge the program files from the system once installed.

You cannot go back to Girlfriend 7.0 because Wife 1.0 is designed to not allow this. Look in your Wife 1.0 manual under Warnings-Alimony/Child Support . I recommend that you keep Wife 1.0 and work on improving the situation. I suggest installing the background application “Yes Dear”
to alleviate software augmentation.

The best course of action is to enter the command C:\APOLOGIZE! because ultimately you will have to give the APOLOGIZE command before the system will return to normal anyway.

Wife 1.0 is a great program, but it tends to be very high maintenance. Wife 1.0 comes with several support programs, such as Clean and Sweep 3.0 , Cook It 1.5 ! and Do Bills 4.2 .

However, be very careful how you use these programs. Improper use will cause the system to launch the program Nag Nag 9.5. Once this happens, the only way to improve the performance of Wife 1.0 is to purchase additional software. I recommend Flowers 2.1 and Diamonds 5.0 !

WARNING!!! DO NOT, under any circumstances, install Secretary With Short Skirt 3.3 . This application is not supported by Wife 1.0 and will cause irreversible damage to the operating system!

Best of luck,

Tech Support
Share and Enjoy!Barbara Meyer-Spidell
